Terms of Service

divorce-lawyers.net.au and this service ('Online Divorce by Freemont Family Lawyers', 'the service') are operated by Max Power Holding Pty Ltd (ACN 621 437 992) trading as Freemont Family Lawyers, ABN 23 621 437 992, an incorporated legal practice. Liability limited by a scheme approved under Professional Standards Legislation. These terms summarise how the service works; before you pay, you receive a formal costs agreement and disclosure that governs the engagement.

What we do

This is a limited-scope engagement. We prepare, check and file your divorce application in the Federal Circuit and Family Court of Australia and handle service and the hearing as described on our Pricing page. Property settlement, parenting orders and other family law work are not included unless we separately agree in writing.

Fixed fees and court fees

Professional fees are fixed as published (joint $1,200, sole $1,500, incl. GST) plus the Court's filing fee. Any work outside the fixed fee is quoted in writing and agreed before any work starts. Money paid in advance is held in our trust account in accordance with the Legal Profession Uniform Law until it may be applied.

Your obligations

You agree to provide accurate, complete information and documents. Eligibility and dates are confirmed by a lawyer before anything is filed. Every applicant completes an identity check and a short verification video call before filing.

Our guarantee

If the Court rejects an application because of our error, we correct and re-file it at no additional professional fee to you.

Timeframes

Our turnaround times are our usual practice, not a promise. Court listing times are set by the Court, with hearings listed in order of filing.

No guarantee of outcome

Only the Court can grant a divorce. We do not guarantee any particular outcome.

Ending the engagement

You may end the engagement at any time. Unearned fees held in trust are returned in accordance with the costs agreement.
