  2. 2. Your application is prepared and checked by a real family lawyer

    A real family lawyer prepares your application and checks it before it is filed. We send you the draft to review and correct.

  3. 3. We file and take it from there

    We file your application with the Federal Circuit and Family Court of Australia and appear for you at the first hearing, if the Court requires an appearance.

Most divorce applications do not require anyone to attend. Any hearing after the first hearing is separate work, except where a further hearing is needed because of an error on our part. We will always tell you, in writing, what it will cost before any such work starts, and we will not start it without your agreement.

Applying for divorce online: what you'll need

Have these details and documents ready for your application. Read our guide to divorce papers and documents:

  • Your marriage certificate. If it isn't in English, you'll need an English translation with the translator's affidavit. If you married overseas, the marriage must have been valid where it took place.
  • Your separation date, and any time you lived under one roof after separating. Read about the 12-month separation rule and separation under one roof.
  • Details of any children under 18 and their care arrangements. Children don't stop a divorce, but the Court checks that proper arrangements are in place.
  • Your spouse's address for service, if you're making a sole application. If your spouse won't sign, you can still apply on your own.
  • An eligible concession card if you're applying for the reduced court fee of $390. For a joint application, both of you must hold an eligible card. Read about the cost of divorce. Court fees as at 1 July 2026.

How applying online works

Our lawyers prepare and check your application before it is filed with the Federal Circuit and Family Court of Australia. We send you the draft to review and correct. The Court lists a hearing. If the divorce is granted, the order takes effect one month and one day later.
